Summary
About the Position: This position is located in the Defense Health Agency Legal Services Agency and the duty station is in the Office of General Counsel, Defense Health Agency , at Naval Medical Center, Portsmouth, Virginia. Note: Salary negotiation may be available for those candidates who are new to Federal service. Leave accrual negotiation may be available for those candidates who are new to Federal service.
Duties
Conduct research of statutory, regulatory, court and administrative precedents, and governing policy using available legal research tools.
Integrate administrative law with related health-care legal issues to review actions, draft pleadings and memorandums and to provide recommendations on legal sufficiency.
Draft legal opinions and responses for Director signature on legal issues involving healthcare law and administrative law.
Conduct discussions, interviews, etc., with prospective witnesses and other agency officials pertinent to various legal matters and appropriate resolutions.
Assist Network and military medical treatment facilities (MTF) attorneys, legal advisors and MTF representatives with appeals, hearing requests, complaints, and peer review hearings.
Draft due process documents/allegations and legal sufficiency reviews for Clinical Adverse Actions, Other Adjudicated Action Reporting, and Graduate Medical Education Adverse Actions.
Conduct tort claim investigations, prepare litigation reports, and provide litigation support for tort cases being litigated in Federal Court.
Attend Healthcare Risk Management and Credentialing/Privileging meetings to appropriately track health law cases and issues.
